2              APPROVAL OF ZONING COMMISSION MINUTES:

Zoning Commission - Regular Meeting - Dec 10, 2019 6:30 PM

Chair Smith informed the Commissioners, that the vote regarding the minutes would be postponed until the upcoming meeting.

3              OLD BUSINESS

SUP-2019-12 (Continuous Specific Use Permit) Presentation and Discussion on a Recommendation on Requests by Bobby Anderson,  for a Continuous Specific Use Permit for Assembly and Packaging, Manufacturing, and Entertainment-Indoor Use all Being Located at 5415 Bandera Road; Generally Located on the North Side of Bandera Road, Approximately 0.4 miles East of Loop 410; and Public Hearings on Said Requests.

Chair Smith called recess at 6:41 PM as applicant was not present and reconvened at 6:43 PM when the applicant was present.

 

Director Melland, presented the Commissioners with a request for three Continuous Specific Use Permits and a Specific Use Permit. The Continuous Specific Use Permits are for Assembly/Packaging, Manufacturing, and Entertainment Indoor.

 

Vice Chair Alonzo requested clarification regarding the difference between Continuous Specific Use Permits and a Specific Use Permit.

 

Director Melland responded that the Continuous Specific Use Permit would be viewed from a macro level instead of a specific suite/tenant.

 

Director Melland advised that Continuous SUP’s provide more flexibility, as opposed to regular SUP’s which have the potential to provide some level of uncertainty; particularly on a large facility. Hence why additional levels of analysis are necessary, in calculating the extent to which these specific uses could proliferate. In this case, Staff considers surrounding uses, noise, parking, and traffic impact to be the primary factors for consideration.

 

2ND Alternate Powers inquired if refuse and disposable items would be contained indoors or would the applicant request outside storage.

 

Director Melland stated that outside storage would be discussed with a separate SUP it could be allowed with conditions.

 

Vice Chair Alonzo wanted to know if current tenants are allowed to store materials outside.

 

Director Melland responded no, hence the request for outside storage.

 

Bobby Anderson provided clarification regarding the request for outside storage, stating that it would be in the best interest of tenants so that they could avoid citations for outside storage. 

 

Director Melland advised that the request be approved subject to the condition that Assembly and Packaging, Manufacturing, and Entertainment Indoor Uses be conducted entirely indoors.

 

Chair Smith opened the Public Hearing for Assembly and Packaging at 7:05 PM and closed the Public Hearing at 7:05 PM.

 

Chair Smith opened the Public Hearing for Manufacturing at 7:05 PM and closed the Public Hearing at 7:05 PM.

 

Chair Smith opened the Public Hearing for Entertainment Indoor Use at 7:05 PM and closed the Public Hearing at 7:05 PM.

 

A motion was made by Vice Chair Alonzo and seconded by 2nd Vice Chair Rowse to approve SUP-2019-12 as presented by Staff.

SUP-2019-15 (Specific Use Permit) Presentation and Discussion on a Recommendation on a Request by Bobby Anderson, for a Specific Use Permit for Outside Storage at 5415 Bandera Road; Generally Located on the North Side of Bandera Road, approximately 0.4 miles East of Loop 410; and a Public Hearing on Said Request.

Chair Smith opened the discussion by asking what kind of storage is currently being conducted on the premises.

 

Director Melland responded that the current outside storage consisted of vehicles.

 

Staff recommended approval of the Specific Use Permit for Outside Storage, subject to the conditions presented:

 

Vice Chair Alonzo wanted to know how an excessive number of vehicles on the property would be avoided.

 

Director Melland advised that per the Zoning the Certificate of Occupancy would not be issued if there is not a sufficient amount of parking spaces.

 

Commissioner 4 Proffitt inquired as to how inoperable vehicles and contractor trailers would be handled.

 

The applicant Mr. Bobby Anderson, responded that all vehicles parked on property would have to be licensed and registered.

 

Chair Smith opened the public hearing at 7:20 PM and closed the public hearing at 7:20 PM.

 

A motion was made by Commissioner 04 Proffitt and seconded by Vice Chair Alonzo to approve Specific Use Permit (SUP-2019-15) as presented by Staff and with the condition that no hazardous materials be stored outside.

4              NEW BUSINESS

SUP-2019-14 (Specific Use Permit) Presentation and Discussion on a Recommendation on a Request by Alfonso Diez Gutierrez, for a Specific Use Permit for Manufacturing at 5405 Bandera Road; Generally Located on the North Side of Bandera Road, approximately 1/2 Mile East of Loop 410; and a Public Hearing on Said Request.

Director Melland informed the Commissioners that the applicant was not able to be present because of illness but advised that the open hearing take place and the item be tabled to avoid further notices having to be sent out.

 

With no objection from the Commissioners, Chair Smith agreed to tabling the item to a later date.

 

Chair Smith opened the public hearing at 6:39 PM and then closed the public hearing at 6:39 PM.

 

A motion was made by Commissioner 06 Pfau and seconded by 2nd Alternate Power to table the item until the upcoming January 28th meeting.
