PURPOSE

 

The purpose of this M & C is to approve an Ordinance amending Ordinance No. 2017-53, to correct an error in the legal description for Zoning Case No. 2017-402, which was to rezone 23 acres near the corner of Grissom and Timberhill, from R-3A Multiple Family Retirement Community District to R-3 Multiple Family and B-2 Retail zoning districts.

 

Zoning Case No. 2017-402 was approved by City Council on September 5, 2017; however, the legal description in the body of the ordinance was entered incorrectly. This ordinance will amend the original ordinance to correct the legal description of the land being rezoned and will add the metes and bounds of the property to the Ordinance.

 

This action does not change the City Council approved boundaries of the zoning requests.

AN ORDINANCE AMENDING ORDINANCE NO. 2017-53 TO CORRECT THE PROPERTY LEGAL DESCRIPTION.

 

WHEREAS, Ordinance No. 2017-53 was passed and approved on September 5, 2017; and

 

WHEREAS, the legal description in said Ordinance of the subject property was incorrect; and

 

WHEREAS, it is necessary to amend Ordinance No. 2017-53 in order to correct said legal description; and

 

WHEREAS, the City Council of the City of Leon Valley desires to amend Ordinance No. 2017-53 in order to correct the legal description of the property;  NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, THAT:

 

Section 1.              Section 1 of Ordinance No. 2017-53 is hereby amended to read as follows:

 

Property being described as 20.98 acres, being all of Lot 1, Block 102, CB 4433, Cottages at Timberhill Subdivision, and a portion of a called 21.612 acre tract (Tract 1), and a portion of a called 2.364 acre tract (Tract 2), as shown in Exhibit A, generally located between Timberhill Drive and the 5500 block of Grissom Road, and more particularly described in case file ZC #2017-402 are hereby rezoned from R-3A (Multi-family Retirement Community District) Sustainability Overlay District to R-3 (Multi-Family Dwelling District) Sustainability Overlay District.

 

2. Property being described as 2.32 acres, being Lots 2 and 3, Block 102, CB 4433, Cottages at Timberhill Subdivision, as shown in Exhibit B, generally located between Timberhill Drive and the 5500-5600- block of Grissom Road, and more particularly described in case file ZC #2017-402, is hereby rezoned from the R-3A (Multi-family Retirement Community District) Sustainability Overlay District to B-2 (Retail District) Sustainability Overlay District.

 

3. That the City's Official Zoning Map is hereby amended to reflect the above approved zoning.

 

4. The City staff is hereby authorized to issue said zoning when all conditions imposed by the City Council have been addressed in full.

 

Section 2.              The repeal of any Ordinance or part of Ordinances effectuated by the enactment of this Ordinance shall not be construed as abandoning any action now pending under or by virtue of such Ordinance as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions at the time of passage of this Ordinance.

 

Section 3.              This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.
