PURPOSE

 

The purpose of this M & C is to consider amending Leon Valley City Code Chapter 3 Building Regulations, Article 30.05 Fences, Section 3.05.005 Dimensions and appearance, (a) Residential fences., (1), to allow property owners to erect fences in the required front yard higher than the currently allowed  three (3’) foot height.

 

The low type decorative fencing being sold in stores, such as Home Depot and Lowe’s, typically comes in three foot four inch tall dimensions and are designed to be decorative./The change in the ordinance would accommodate this height. The amendment would allow a fence in the front yard 44” in height.

Social - Amending codes periodically assures that all citizens are not burdened with being required to comply with outdated codes.

 

Economic - Requiring a citizen to purchase a custom fence will cost them more money than if they are able to purchase an “off the shelf” product. Processing variance requests costs the City time and money in personnel and supplies.

 

Environmental - Property owners that consistently improve the appearance of their homes and property are more apt to keep their properties free and clear of debris and standing water from such debris, which helps to improve our environment.

 

FISCAL IMPACT

 

None to the City, but this change allows the property owner to pay standard prices for these types of items, instead of having to have a custom fence made.

It recommended the Council approve amending the Leon Valley City Code of Ordinances, Chapter 3 Building Regulations, Article 3.05 Fences, Section 3.05.005 Dimensions and appearance (a) Residential fences., (1),  to Increase the Allowed Height of a Fence in the Required Front Yard of a Residential Property from Three Foot (3') in height to Forty-Four Inches (44") in height.

AN ORDINANCE AMENDING THE CITY OF LEON VALLEY CODE OF ORDINANCES, CHAPTER 3 BUILDING REGULATIONS, ARTICLE 3.05 FENCES, SECTION 3.05.005 DIMENSIONS AND APPEARANCE (a) RESIDENTIAL FENCES., (1), TO INCREASE THE ALLOWED HEIGHT OF A FENCE IN THE REQUIRED FRONT YARD OF A RESIDENTIAL PROPERTY, FROM THREE FEET (3') IN HEIGHT TO FORTY-FOUR INCHES (44") IN HEIGHT.

 

WHEREAS, amending City Codes periodically assures that citizens are not burdened with being required to comply with outdated codes;

 

WHEREAS, staff has determined that requiring citizens to purchase custom fences will cost more than purchasing a product off the shelf; and

 

WHEREAS, processing variance requests for fences 8 inches (8”) more in height costs the City time and money in personnel and supplies; and

 

WHEREAS, the City of Leon Valley encourages property owners to improve the appearance of their homes and property; and

 

WHEREAS, property owners with fences are more apt to keep their properties free and clear of debris and standing water from such debris, which helps to improve our environment; NOW THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS:

 

Section 1. That the Leon Valley City Code of Ordinances, Chapter 3 Building Regulations, Section 3.05.005(a)(1) is entirely deleted and replaced with the following language:

 

“Residential fences shall not exceed six (6) feet in the height in the side or rear yards or forty-four inches (44”) in height in the required front yard. The finished side shall face toward the public viewpoint or public right-of-way.”

 

Section 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict.  All provisions, sections and sub-sections set forth in Article 3.05 Fences not revised or amended herein shall remain in effect.

 

Section 3. This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.
