PURPOSE

 

Vote to Ratify the General Fund Fiscal Year 2018 Budget that will raise more total property taxes than last year’s budget by $100,000 or 2.6315% and of that amount $30,068.81 is tax revenue to be raised from new property added to the roll this year

During the 80th legislative session, H.B. 3195 was enacted. In order for the General Fund Budget to be adopted that will require raising more revenue from property taxes than in the previous year a separate vote of the governing body is required to ratify the property tax increase reflected in the budget.  A vote under this section is in addition to and separate from the vote to adopt the budget or a vote to set the tax rate.

The attached provides the funding mechanism for City operations for the General Fund.

It is recommended that the City Council vote to ratify the General Fund Fiscal Year 2018 Budget

RATIFYING THE FISCAL YEAR 2018 BUDGET THAT WILL RAISE MORE TOTAL PROPERTY TAXES THAN LAST YEAR’S BUDGET BY $100,000 OR 2.6315% AND OF THAT AMOUNT $30,068.81 IS TAX REVENUE TO BE RAISED FROM NEW PROPERTY ADDED TO THE ROLL THIS YEAR.

 

WHEREAS, during the 80th Legislative Session, the Texas legislature enacted H.B. No. 3195 to amend Section 102.007 by adding Subsection (c) to the Texas Local Government Code; and

 

WHEREAS, said Subsection (c) states that the adoption of a budget to raise more revenue from property taxes than in the previous year requires a ratification of the property tax increase reflected in the budget; and

 

WHEREAS, City Council desires to raise more revenue from property taxes in the Fiscal Year 2018 Budget than in the Fiscal Year 2017 Budget by $100,000 or 2.6315%; and

 

WHEREAS, it is necessary to ratify the property tax increase reflected in the Fiscal Year 2018 Budget; NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1.              The General Fund Budget and associated Capital Acquisition Plan for the City of Leon Valley, Texas, for the Fiscal Year 2018, that will raise more total property taxes than the Fiscal Year 2017 Budget by $100,000 or 2.6315% is hereby ratified.

 

Section 2.              No expenditure of the funds of the City shall be made during said fiscal year except in strict compliance with the Fiscal Year 2018 Adopted Budget.

 

Section 3.              This Ordinance shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage hereof.

A motion was made by Council Member Benny Martinez and seconded by Council Member David Jordan to adopt the ordinance ratifying the Fiscal Year 2018 budget that will raise more total property taxes than last year’s budget by $100,000 or 2.6315% and of that amount $30,068.81 is tax revenue to be raised from new property added to the roll this year.

Mayor Riley requested a call vote to which the City Council replied: Council Member Edwards - Absent; Council Member Alcocer - Absent; Council Member Martinez - Aye; Council Member Jordan - Aye; and Council Member Ealy - Aye. Upon a unanimous vote, Mayor Riley announced the motion carried.
