PURPOSE

 

The purpose of platting properties is for future development.  The platting process allows the boundaries of the property to be defined and all public improvements, infrastructure  and drainage requirements to be reviewed for conformance with the City's Subdivision Code.

 

Parcel 64, Abstract 664, CB 4446, generally located at 7228 Bandera Road is being requested for platting to Lot 3, CB 4446, establishing the new We Care Shopping Center Subdivision. 

 

This property was known for a number of years as the residence of Ms. Jo Anna Steubing.  Ms. Steubing became ill and moved to assisted living and has sold the property to Jonah and Jean Obasi.

 

The City's engineer has reviewed the plat and has found it to be in substantial conformance to the Leon Valley Subdivision Code.

 

There are no outstanding items and no variances requested to this plat.

Social Equity - It is an equitable process for a property owner to request platting for the proper development of their property. It also allows the City to ensure proper drainage, infrastructure and public improvements.

 

Economic Development - The property is zoned B-2 (Retail), retail services and products can provide new businesses in the City, which will in turn, generate sales tax.

 

Environmental Stewardship - The Oak trees on the property will be required to be preserved.  Site development will require streetscape, street trees, and other landscaping.

 

FISCAL IMPACT

 

The applicant has paid $1,057 for consideration of this plat.

 

STRATEGIC GOALS

 

This request indirectly aligns with Strategic Goal #4, "Infrastructure/Capital Plan."  A plat has to meet the required infrastructure requirements and bonding, so that the City does not have to construct them.

APPROVING A SUBDIVISION PLAT BEING APPROXIMATELY 2.50 ACRES OF LAND, ESTABLISHING NEW LOT 3, CB 4446, WE CARE SHOPPING CENTER SUBDIVISION, IN THE CITY OF LEON VALLEY.

 

WHEREAS, the City of Leon Valley received a request by Modeco, LLC on behalf of Jonah and Jean Obasi, to plat approximately 2.50 acres of land being Lot 3, CB 4446, We Care Shopping Center Subdivision.

 

WHEREAS, the final plat conforms to Chapter 10, "Subdivisions," of the Leon Valley Code of Ordinances; and

 

WHEREAS, notice was provided pursuant to Chapter 212 of the Texas Local Government Code and a public hearing was held on March 21, 2017 regarding this subdivision plat, at which time parties in interest and citizens were given an opportunity to be heard; and

WHEREAS, it is now the desire of the City Council of the City of Leon Valley to approve a subdivision plat for the We Care Shopping Center Subdivision;

 

NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1.  A subdivision plat has been found to be in substantial conformance and is hereby approved as approximately 2.50 acres of land, being new Lot 3, CB 4446, the WE CARE SHOPPING CENTER SUBDIVISION.

 

Section 2.  The City staff is hereby authorized to file said plat when all conditions imposed by City Council as reflected in Replat File No. 2017-003 have been complied with in full.

 

Section 3.  A description of the property is attached hereto and incorporated herein as Exhibit "A."

 

Section 4.  This Ordinance shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage hereof.
