PURPOSE

 

The purpose of this item is to enter into a Land Use Agreement for County Block (CB) 4431C, Block 101, Lot 105, Shadow Mist Subdivision UT-1 Parkland Dedication with Oscar Renda Contracting. Oscar Renda Contracting is the current contractor for the LC 17 Project, and would like to use the mentioned piece of land to store dirt on from May 16, 2017 through September 30, 2018. In consideration for the storage of the dirt, the City of Leon Valley will receive grade from existing concrete channel for positive drainage and a new, approximately 1.5 acre parking lot in an area which has already been designated by the Park Commission as a parking lot area which is adjacent to the Crystal Hills Park in the City of San Antonio.

Social: By installing the parking lot, we are providing a pathway to recreation for all citizens.

 

Economic Development: The more parks and green spaces we have, the more inclined residents and businesses will be to located within our city limits. 

 

Environmental: The installation of permeable pavers is a part of the best management practices of our storm water MS4 permit. By allowing the stormwater to settle instead of run off, we are reducing pollution. 

 

FISCAL IMPACT

 

There is a positive impact financially to the taxpayer of Leon Valley. The parking area will now be paid for by Oscar Renda Contracting (the permittee) in consideration for the use of the City's land. A regular asphalt parking lot would cost between $70,000 to $90,000 and an LID parking lot would cost between $70,000 and $80,000.

 

STRATEGIC GOALS

 

This Resolution is consistent with the Strategic Goal of Economic Development in that more parks and green spaces lead to an attractive area for businesses and residents both to locate. It is also consistent with the Strategic Goal of Parks, Recreation, Green Spaces and Cultural Opportunities in that it provides access to both a hike and bike trail and what will be Crystal Hills Park.

AUTHORIZING THE NEGOTIATION AND EXECUTION OF A LAND USE AGREEMENT WITH OSCAR RENDA CONTRACTING IN EXCHANGE FOR AN APPROXIMATELY 1.5 ACRE PARKING LOT ADJACENT TO THE CRYSTAL HILLS PARK.

 

WHEREAS, the current contractor for the LC 17 Project, Oscar Renda Contracting, requests the use of County Block (CB) 4431C, block 101, lot 105, Shadow Mist Subdivision UT-1 Parkland Dedication, to store dirt from May 16, 2017 through September 30, 2018; and

 

WHEREAS, in consideration for the storage of the dirt, the City of Leon Valley will receive grade from existing concrete channel for positive drainage and a new, approximately 1.5-acre parking lot, in an area designated by the Park Commission as a parking lot area adjacent to the Crystal Hills Park in the City of San Antonio; and

 

WHEREAS, by installing the parking lot, the City will provide a pathway to recreation for all citizens of Leon Valley; and

WHEREAS, in order to accomplish the City’s strategic goals of parks, recreation, green spaces and cultural opportunities, it is necessary that City Council authorize this Land Use Agreement; and

 

WHEREAS, it is now the desire of the City of Leon Valley Council to authorize the negotiation and execution of a Land Use Agreement with Oscar Renda Contracting in exchange for a 1.5-acre parking lot adjacent to the Crystal Hills Park; NOW THEREFORE,

 

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

SECTION 1.              The negotiation and execution of a Land Use Agreement with Oscar Renda Contracting in exchange for a 1.5-acre parking lot adjacent to the Crystal Hills Park is hereby authorized.

 

SECTION 2. Said Land Use Agreement is attached hereto and incorporated herein as Exhibit A in substantially final form.

 

SECTION 3.              This Resolution shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage

City Manager Kelly Kuenstler presented the item to enter into a Land Use Agreement for County Block (CB) 4431C, Block 101, Lot 105, Shadow Mist Subdivision UT-1 Parkland Dedication with Oscar Renda Contracting. City Manager Kuenstler concluded the presentation saying there is a positive impact financially to the taxpayer of Leon Valley. · Donna Charles,6546 Charles Field, made a request that the dirt be watered down when the weather is really dry.

o Mr. Simmons said that would not be a problem.

Council Member Benny Martinez spoke on the proposed contract stating that he would like to see the wording “owner” stricken and replaced with “City”. City Council Members Alcocer, Jordan and Edwards all said they agree with the wording as provided by City Attorney Denise Frederick as presented.

A motion was made by Council Member Monica Alcocer and seconded by Council Member David Edwards to authorize the Negotiation and Execution of a Land Use Agreement between the City of Leon Valley and Oscar Renda Contracting in exchange for an approximately 1.5-acre Parking Lot Adjacent to the Crystal Hills Park as presented.

Council Member Alcocer amended the motion to include the agreement by Mr. Jim Simmons’ to water down the dirt as discussed. Council Member Alcocer asked Council Member Edwards if he would accept her amendment to which he said he did and then he seconded her amended motion.
