PURPOSE

 

The purpose of this ordinance is to amend the City of Leon Valley Appendix A Fee Schedule to create a $25 Property Room Handling Fee. This fee would be charged to persons retrieving lost property, abandoned property, personal property, and evidence from a crime that has been adjudicated. The fee would not be charged to a victim of a crime and may be waived for indigent persons if approved by the Chief of Police.  

 

SEE LEON VALLEY

 

Social Equity- The new fee will ensure that those using the services of the property room pay their fair share for the handling of their property.

 

Economic Development- The changes to the Appendix A Fee Schedule creating a new fee raises additional monies for the General Fund of the City of Leon Valley.

 

Environmental Stewardship- The Amendment to the Appendix A Fee Schedule allows additional monies to help maintain a professional property room and ensure all evidence is properly stored, maintaining the health, safety and welfare of all who come in contact with it.

 

FISCAL IMPACT

 

The approval of this ordinance amending the City of Leon Valley Appendix A Fee Schedule creating a $25 Property Room Handling Fee may generate an additional $4,000 or more in revenue for the General Fund.

 

STRATEGIC GOALS

 

The Amendment to the Appendix A Fee Schedule meets Strategic Goal 2 - Safety and Security, as it ensures monies are available to ensure evidence is handled properly, safely and securely.

APPROVING THE AMENDMENT TO THE CITY OF LEON VALLEY APPENDIX “A” FEE SCHEDULE TO ADD A NEW SECTION, SECTION A2.013 “POLICE DEPARTMENT PROPERTY ROOM HANDLING FEE” TO ARTICLE A2.000 “ADMINISTRATIVE FEES”, FOR HANDLING AND STORAGE OF LOST PROPERTY, ABANDONED PROPERTY, PERSONAL PROPERTY, AND EVIDENCE OF A CRIME THAT HAS BEEN ADJUDICATED.

 

WHEREAS, the City Council of City of Leon Valley wishes to amend the City of Leon Valley Appendix “A” Fee Schedule to add a new section, Section A2.013 “Police Department Property Room Handling Fee” to Article A2.000 “Administrative Fees”; and

 

WHEREAS, the fee would be for the retrieval of lost property, abandoned property, personal property, and evidence from a crime that has been adjudicated and that is stored in the Leon Valley Police Department Property Room; and

 

WHEREAS, it was determined that the fee would be advantageous and beneficial to the health, safety and welfare of the City and its citizens; and

 

WHEREAS, this fee will off-set the cost of storing personal and prisoner property; and

 

WHEREAS, the storage fee would not be assessed to victims of crime and may not be assessed to indigent persons; NOW, THEREFORE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT: 

 

SECTION 1. Appendix A Fee Schedule is hereby amended to add a new section, Section A2.013 “Police Department Property Room Handling Fee” to Article A2.000 “Administrative Fees” as follows:             

 

Article A2.000 Administrative Fees

 

Section A2.013 Police Department Property Room Handling Fee

 

(a)              Police Department Property Room Handling Fee for the retrieval of lost,               abandoned and personal property and evidence from a crime that has been               adjudicated and that is stored in the Leon Valley Police Department Property               Room: $25.00 per item.

 

(b)              Method of payment: Exact cash, cashier’s check, money order, or credit card at a               3% fee

 

SECTION 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict. All provisions, sections and sub-sections set forth in Appendix “A” Fee Schedule not revised or amended herein shall remain in effect.

 

SECTION 3. This Resolution shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage

Lastly, Captain Saucedo presented this item for the purpose of amending the City of Leon Valley Appendix A Fee Schedule to create a $25 Property Room Handling Fee. This fee would be charged to persons retrieving lost property, abandoned property, personal property, and evidence from a crime that has been adjudicated. The fee would not be charged to a victim of a crime and may be waived for indigent persons if approved by the Chief of Police.

A motion was made by Council Member Monica Alcocer and seconded by Council Member David Edwards to adopt an ordinance amending the City of Leon Valley Appendix A Fee Schedule to create a $25 Property Room Handling Fee for handling lost property, abandoned property, personal property, and evidence from a crime That has been adjudicated and is stored in the police property room.
