PURPOSE

 

The purpose of this ordinance is to amend the City of Leon Valley Appendix A Fee Schedule to establish the fees for vehicles towed to and for the storage in the Leon Valley Vehicle Impound Lot.

 

S.E.E. LEON VALLEY

 

Social Equity - Adding fees to offset the costs of the newly created impound lot in Leon Valley ensures our administration is exploring every option for ensuring proper revenue to keep the costs down for all citizens in our community.

 

Economic Development - The raising of additional revenue assists the City of Leon Valley in keeping taxes low and ensuring we are fiscally responsible to our taxpayers.

 

Environmental Stewardship - The impound lot will remove vehicles from the roadways that are no longer operable. This will help the environment and air quality for all residents of Leon Valley.

 

FISCAL IMPACT

 

The proscribed fees would allow Leon Valley to increase the City’s revenues by an estimated $125,300 in the first year of this new program.

STRATEGIC GOALS

 

This Ordinance would support Goal #2 Safety and Security as it would set fees on all vehicles that were removed as abandoned or deemed traffic hazards, as well as stopping people whom drive without insurance, putting our residents in danger.

Staff recommends the approval of this Ordinance amending the City of Leon Valley Appendix A Fee Schedule, and establishing the fees for vehicles towed to and for the storage in the Leon Valley Vehicle Impound Lot.

AMENDING THE CITY OF LEON VALLEY CODE OF ORDINANCES APPENDIX “A” FEE SCHEDULE, TO ADD A NEW ARTICLE A18.000 "IMPOUND LOT FEES".

 

WHEREAS the City of Leon Valley has established an Impound Lot for the purpose of storing and reclamation of nuisance vehicles; and

 

WHEREAS the storage of such vehicles requires the City to incur expenses related to such storage; and 

 

WHEREAS the citizens of Leon Valley are entitled to receive compensation for such expenses as related to stored vehicles; NOW THEREFORE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS:

 

SECTION 1. That Appendix "A" Fee Schedule is hereby amended to add an Article A18.000 "Impound Lot Fees" as follows:             

 

              Article A18.000 Impound Lot Fees

 

              (1)               Wrecker Towing and Storage Fees:

                            Towing Fee Charged Per Vehicle and Per Type

 

                                          (a) Wrecker Tow fee up to 25 feet in length                            $95.00

 

                                          (b) Heavy Duty Vehicles                                                                      $425

 

                                          (c) Vehicles Greater than 25 Feet in Length                            $225

 

                                          (d) Recreational Vehicles                                                                       $125

                                         

                                          (e) Tilt-Bed Vehicle Towing                                                        $95

                                         

                                          (f) Off Road or Winching of Vehicle                                          $225

 

                                          (g) Per mile Charge Outside of Leon Valley                            $3

 

                                          (h) Storage fee (first 24 hours)                                                        $200.00

 

                                          (i) Daily fee (after first 24 hours)                                                        $20.00

 

                                          (j) Certified letter of abandonment (each letter)                            $25.00

 

                                          (certified letter to be sent to address on registration and lien holder                                                         if applicable)

 

              (2)              Retrieval of Vehicle - To retrieve a vehicle from the impound facility, the                                           retriever must be the registered owner of the vehicle, and must present a                                           valid and current driver’s license, valid and current insurance and                                                         registration documents, and must not have any outstanding warrants for                                           arrest.

 

SECTION 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict. All provisions, sections and sub-sections set forth in Appendix “A” Fee Schedule not revised or amended herein shall remain in effect.

 

SECTION 3. This Resolution shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage.

A motion was made by Council Member David Jordan and seconded by Council Member Monica Alcocer combining agenda Items 7.12, 7.13 and 7.14 a) Amending the Leon Valley City Code of Ordinances, Chapter 12, "Traffic and Vehicles", to add Article 12.06 "Impound Lot"; and Authorizing the Establishment of a City Operated Impound Lot and the Procedures for the Operation of a City Operated Impound Lot; b) Amending the Leon Valley Police Department FY17 General Fund Budget in the amount of $8,650 to Provide Funding to Operate the City of Leon Valley Impound Lot; and c) Amending the City of Leon Valley Appendix A Fee Schedule, Setting Fees for the Impounding of Vehicles in the Leon Valley Vehicle Impound Lot.
