Item Discussion

PURPOSE

 

Request for Qualifications (RFQ) were solicited from attorneys for the collection of municipal court fines and fees and delinquent Ad Valorem Taxes for the City of Leon Valley. A total of 209 requests were sent out and only two were received back. They are follows:

 

Linebarger Goggan Blair & Sampson

Perdue Brandon Fiedler Collins & Mott, LLP

 

A selection committee (SC) was formed to review and score the proposals submitted and consisted of Crystal Caldera, Faviola Garcia, Ashley Wayman and Vickie Wallace.

 

Based on the scoring criteria included in the RFQ the top firm was Linebarger Goggan Blair & Sampson, LLP

             

For the collection of delinquent ad valorem taxes the average collection rates are as follows:

 

Linebarger Goggan Blair & Sampson, LLP -   99%

Perdue Brandon Fiedler Collins & Mott, LLP - 85%

 

There is no fee associated with this contract that the City has to pay. The fee for the collection of delinquent taxes is paid by the delinquent taxpayer. Both firms will charge the taxpayer 15%.

 

For the collection of municipal court fines and fees the average accounts resolved are as follows:

 

Linebarger Goggan Blair & Sampson, LLP -   47%

Perdue Brandon Fiedler Collins & Mott, LLP - 47%

 

There is no fee associated with this contract that the City has to pay. The fee for the collection of Municipal Court Fees & Fines is paid when the defendant pays the fine. Both firms propose a fee of 30% of all monies actually collected.

Social -  Municipal Court Fines and fee collections and Ad Valorem taxes fund the activities of public safety,  public works, City administration and other City programs and  services in the General Fund, as well as City debt.

 

Economic Development - The collection of delinquent ad valorem taxes assists the city’s economic development overall in that all who do business and own property in the city are held accountable for paying the lawful tax imposed on their property and these funds will enhance the sustainability and quality of life in the city. Having a sustainable city with a superior quality of life improves economic development.

FISCAL IMPACT

 

Funding for the collection services is derived from a 15% penalty assessment on the delinquent taxes collected and is paid by the taxpayer.

 

For the collection of municipal court fines and fees a 30% surcharge is assessed on the municipal court fines and fees that are collected by Linebarger. The surcharge is paid by the defendant.

 

STRATEGIC GOALS

 

This item supports strategic goal number two, safety and security. These funds help support activities of public safety, public works, City administration and other City programs and  services in the General Fund, as well as City debt.

AN ORDINANCE SELECTING LINEBARGER, GOGGAN, BLAIR & SAMPSON, LLP

FOR NEGOTIATION AND EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT FOR THE COLLECTION OF MUNICIPAL COURT FINES AND FEES AND DELINQUENT AD VALOREM TAXES FOR THE CITY OF LEON VALLEY.

 

WHEREAS, proposals were submitted in connection with the collection of municipal court fines and fees and delinquent Ad Valorem Taxes; and

 

WHEREAS, this Ordinance selects the proposal submitted by Linebarger, Goggan, Blair & Sampson, LLP for negotiation and execution of a Professional Services Agreement; and

 

WHEREAS, there is no fee associated with this contract that the City has to pay; and 

 

WHEREAS, the fee for the collection of delinquent taxes is paid by the delinquent taxpayer; and

 

WHEREAS, Linebarger, Goggan, Blair & Sampson, LLP will charge the taxpayer 15%; and

 

WHEREAS, the fee for the collection of municipal court fees and fines is paid when the defendant pays the fine; and

 

WHEREAS, Linebarger, Goggan, Blair & Sampson, LLP proposes a fee of 30% of all monies actually collected of Municipal Court Fees & Fines; and

 

WHEREAS, it is the desire of the City Council of the City of Leon Valley to select Linebarger, Goggan, Blair & Sampson, LLP for the collection of municipal court fines and fees and delinquent Ad Valorem Taxes and authorize the City Manager to negotiate and execute a professional services agreement for said service; NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT: 

 

Section 1.              Linebarger, Goggan, Blair & Sampson, LLP is hereby selected for negotiation and execution of a Professional Services Agreement for the collection of municipal court fines and fees and delinquent Ad Valorem Taxes.

 

Section 2.              The City Manager or her designee is authorized to negotiate and execute a Professional Services Agreement for a term of five (5) years.

 

Section 3.              The financial allocations in this Ordinance are subject to approval by the Director of Finance. The Director of Finance, may, subject to concurrence by the City Manager or the City Manager's designee, correct allocations to specific accounts as necessary to carry out the purpose of this Ordinance.

 

Section 4.              This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.

A motion was made by Council Member David Jordan and seconded by Council Member Monica Alcocer to authorize the City Manager to enter into a contract with Linebarger Goggan Blair & Sampson, LLP for collection services of Municipal Court Fines and Fees and Delinquent Ad Valorem Taxes for a five year term.
