PURPOSE

 

City Departments have created an audit process by which businesses are visited and audited to make sure that they have a posted Certificate of Occupancy.

 

The audit began in February 2017 and to date many businesses have applied and received their Certificates but do not have them posted or have misplaced them.

 

Upon verifying that the business does have a Certificate per the Incode permitting system, staff is having to spend valuable time duplicating or recreating Certificates for business owners to post.

 

Community Development staff proposes to recoup the expense of staff verification and preparation, letterhead, and certificate seals by charging a Certified Duplicate Certificate Fee of $125. It is the responsibility of the business owner to ensure they have the proper permitting posted as directed on each certificate issued by the Development Department.

Social Equity - The City encourages public safety and collaborative participation by businesses.  For these reasons, it is important that business owners are operating safe, clean, classified businesses and working with the City for required permitting and licensing.

 

Economic Development - This promotes responsible business owners.  Patrons will be able to identify that businesses are permitted by the City.

 

Environmental Stewardship - Not applicable.

 

FISCAL IMPACT

 

There will be revenue generated to support Building Department operations. 

 

The proposed Certified Duplicate Certificate Fee is $125.

 

STRATEGIC GOALS

 

This request most closely aligns with Strategic Plan Goal #1, “Economic Development,” to retain quality businesses that will generate sales tax revenue.

WHEREAS, the City Council of the City of Leon Valley (the “City”) adopted the City Code of Ordinances through Ordinance No. 13-011, passed and approved on April 2, 2013; and

 

WHEREAS,

 

WHEREAS, the City desires to amend Appendix A “Fee Schedule” to allow for cost recovery of the development processes; NOW THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1:              The City hereby amends Appendix A “Fee Schedule”; Article A.8000," Building and Construction Related Fees," Sec. A8.004, "Miscellaneous Fees," "(a) Certificate of Occupancy," to read as follows:

 

              (1)              Permit Fee:              $125.00.

 

              (2)              Re-inspection Fee: $65.00.

 

              (3)               Certified Duplicate Certificate Fee: $125.00.

 

Section 2:              All ordinances and resolutions and parts or ordinances and resolutions in conflict with this ordinance are hereby repealed to the extent of the conflict.

 

Section 3.              This Ordinance shall be effective immediately upon passage by four (4) or more affirmative votes; otherwise, it shall be effective on the tenth (10th) day after passage.

A motion was made by Council Member Monica Alcocer and seconded by Council Member David Jordan to adopt the ordinance amending the City Code of Ordinances, Appendix A, "Fee Schedule," Article A8.000, "Building and Construction Related Fees," Section A8.004, "Certificate of Occupancy," to add "(3) Certified Duplicate Certificate Fee: $125" as presented.
