PURPOSE

 

In Town Suites Bandera Road Inc., is requesting consideration of an Electronic Message Center sign measuring 85 square feet to be added to their existing 39-foot tall sign pole which has an existing sign face of approximately 298 square feet. The overall sign face would total 383 square feet with the addition of the Electronic Message Center.

 

The applicant has indicated that the Electronic Message Center would be helpful to their business and the surrounding area by: 1) allowing them to communicate involvement initiatives such as Blue Santa, Food Bank Drives and the like, 2) would allow In Town to communicate rates to customers, which would promote occupancy, and 3) would reduce the liability incidents associated with changing out pricing manually.

 

There have been similar variances granted in the area. Bandera North Shopping Center at 6400 Bandera Road was granted a message board sign variance in January 2017, Bandera Center at 6421 Bandera Road in December 2012 and Leon Valley Veterinary Hospital at 6701 Bandera Road in September 2011.

Social Equity - It is equitable for the City to consider In Town Suites request as it promotes stakeholder participation with the City. It also promotes a positive stakeholder relationship for future City endeavors/events.

 

Economic Development - In Town Suites success in Leon Valley will increase sales tax revenue and promote economic development in the City. Their success is contingent on their marketing and visibility through signage and other means.

 

Environmental Stewardship - Not applicable.

 

FISCAL IMPACT

 

A $200 sign variance consideration fee was paid for consideration of this request. If the variance is approved, the applicant will need to obtain a sign permit for installation in the amount of $150.

 

STRATEGIC GOALS

 

This request most closely aligns with Strategic Plan Goal #1, “Economic Development,” to retain businesses and improve occupancy to generate sales tax and revenue.  In Town Suites is a long-time business in Leon Valley and is requesting assistance to further promote their business and the community.

RECOMMENDATION

 

There are similar variances granted in the area, thus staff reviewers have no objection to the variance. Approval is at the discretion of City Council. Chapter 3, “Signs,” of the Code of Ordinances notes that applicants may apply for variances to the Article and that City Council may in turn, consider such variances where strict enforcement due to special conditions or where literal enforcement would result in unnecessary hardship.

GRANTING SIGN VARIANCE #2017-001 ALLOWING AN ELECTRONIC MESSAGE CENTER ON AN EXISTING POLE SIGN ON CERTAIN PROPERTY LOCATED AT 6625 BANDERA ROAD UPON APPLICATION BY IN TOWN SUITES BANDERA ROAD INCORPORATED, APPLICANT AND PROPERTY OWNER.

 

WHEREAS, Chapter 216 of the Texas Local Government Code authorizes a municipality to regulate signs erected within the municipality and provide for their sign ordinance administration, enforcement and amendment; and

 

WHEREAS, the Leon Valley Code of Ordinances Chapter 3 and Chapter 14 (the “Code”) regulates the administration and enforcement of sign provisions within the City; and

 

WHEREAS, the City Council has authority to grant variances to the sign regulations of the Code where special circumstances exist and literal enforcement of the Code would result in unnecessary hardship; and

 

WHEREAS, In Town Suites Bandera Road Incorporated, applicant and owner for a sign variance to allow an electronic message center in an existing pole sign; and

 

WHEREAS, the variance requested will not adversely affect the character of the area, traffic, public health, utilities, safety and general welfare of the residents of the City of Leon Valley; and

 

WHEREAS, it is the desire of the City Council of the City of Leon Valley to grant Sign Variance #2017-001 to allow an Electronic Message Center in an existing pole sign on the property located at 6625 Bandera Road upon application by In Town Suites Bandera Road Incorporated, applicant and property owner; NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1.              Sign Variance #2017-001 is hereby granted for a variance to allow an 85 square foot electronic message center in an existing pole sign on Lot 7, Block 1, CB 4430A, In Town Suites Subdivision, generally located at 6625 Bandera Road, and more particularly described in the case file of Sign Variance #2017-001, attached hereto and incorporated herein as Attachment I.

 

Section 2.               The City staff is hereby authorized to issue said variance when all conditions imposed by the City Council have been addressed and complied with in full.

 

Section 3.  This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.

A motion was made by Council Member Monica Alcocer and seconded by Council Member Belinda Ealy to deny the variance but that he be able to come back after the ordinance is amended but without having to pay a fee.

City Manager Kelly Kuenstler asked that City Council consider allowing staff through summer to bring back a sign amendment. City Council agreed.
