PURPOSE

 

The purpose of this Communication is to consider approving an amendment to Leon Valley City Code Chapter 12 Traffic and Vehicles, Article 12.03 Parking, Stopping, Standing, Section 12.03.006 Parking Restrictions on Certain Streets, to add:

 

“Sawyer Road. The parking, standing, or stopping of any vehicle, whether attended or unattended, upon any portion of the right of way east one thousand eighty-nine (1089’) feet from the intersection of Bandera Road, is prohibited.”

 

Staff has received several complaints regarding numerous large 18-wheeler tractor trailers parking along both sides of Sawyer Road for extended periods of time near the intersection of Bandera Road. The trucks block the vision of motorists entering and exiting the businesses in that area. In order to prevent the trucks and other vehicles from parking in this area, Article 12 Traffic and Vehicles should be amended to make this area a “no parking” zone.

 

FISCAL IMPACT

 

After passage of the amended ordinance, “No Parking” signs will be installed. Funding for the required signage is included in the FY 2017 budget.

Social Equity - Providing the citizens with additional safety measures adds to the overall quality of life.

Economic Development - Reducing perceived and potential dangers from traffic situations promotes overall health, safety, and welfare image of City, which may attract businesses and new residents.

Environmental Stewardship - Reducing standing traffic in this area will help to protect the environment by reducing emissions from idling vehicles and from vehicles being delayed in attempts to enter/exit parking areas.

“Sawyer Road. The parking, standing, or stopping of any vehicle, whether attended or unattended, upon any portion of the right of way for the east one thousand eighty-nine (1089’) feet from the intersection of Bandera Road, is prohibited.”

AN ORDINANCE AMENDING LEON VALLEY CITY CODE CHAPTER 12 TRAFFIC AND VEHICLES, ARTICLE 12.03 PARKING, STOPPING, STANDING, SECTION 12.03.006 PARKING RESTRICTIONS ON CERTAIN STREETS, TO ADD SAWYER ROAD.

 

WHEREAS the City owns and manages a roadway system throughout the City of Leon Valley; and

 

WHEREAS tractor trailer and other vehicular parking within the right of way on Sawyer Road from Bandera east for 1089 feet has been found to obstruct motorist vision as vehicles attempt to enter and exit driveway approaches in that area; and

 

WHEREAS it is the City’s desire to keep all roadways unobstructed, clear, and safe for the traveling public; and

 

WHEREAS the City Engineer has determined that the parking, stopping, or standing along this portion of roadway on Sawyer Road creates a safety hazard for the citizens of Leon Valley; and

 

WHEREAS the Leon Valley City Council hereby finds and determines that the amendment adopted under this ordinance is for a municipal purpose; NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT: 

 

SECTION 1.              That Chapter 12 Traffic and Vehicles, Article 12.03 Parking, Stopping, Standing, Section 12.03.006 Parking Restrictions on Certain Streets, is hereby amended to add the following language:

 

“Sawyer Road. The parking, standing, or stopping of any vehicle, whether attended or unattended, upon any portion of the right of way for the east one thousand eighty-nine (1089’) feet from the intersection of Bandera Road, is prohibited.”

 

SECTION 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict.  All provisions, sections and sub-sections set forth in Chapter 12, including Article 12.03 not revised or amended herein shall remain in effect.

 

SECTION 3.              This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.

Assistant Public Works Director David Dimaline presented the item asking that City Council consider approving an amendment to Leon Valley City Code Chapter 12 Traffic and Vehicles, Article 12.03 Parking, Stopping, Standing, Section 12.03.006 Parking Restrictions on Certain Streets, to add: “Sawyer Road. The parking, standing, or stopping of any vehicle, whether attended or unattended, upon any portion of the right of way east one thousand eighty-nine (1089’) feet from the intersection of Bandera Road, is prohibited.”

The parking, standing, or stopping of any vehicle, whether attended or unattended, upon any portion of the right of way for the east one thousand eighty-nine (1089’) feet from the intersection of Bandera Road, is prohibited.”

A motion was made by Council Member Belinda Ealy and a second by Council Member David Jordan to approve the amendment as presented and to include street and right of way and the first one thousand eighty-nine (1089’) feet from the intersection of Bandera Road.
