PURPOSE

 

The purpose of this item is to review, consider and conduct a public hearing regarding a request by Cook Engineering on behalf of Martin and Gloria Sasser, to replat approximately 0.269 acres of land being Lot 9 and 1/2 of Lot 10, Block G or 11, CB 4446, of the Linkwood Addition Subdivision and establishing new Lot 56, Block G or 11, CB 4446, Linkwood Addition Subdivision.

 

This request is consolidation of substandard property for development. The replat request is in substantial conformance to Chapter 10, Subdivisions. 

 

Per the requirements of the Local Government Code, Chapter 212, a public hearing is being held and twenty-eight (28) notices were sent to property owners within 200-feet.  As of March 8, 2017 no letters were received in favor, opposition or returned undelivered.

Economic Development - Any economic benefit from this property will be by its development and ad valorem tax.

 

Environmental Stewardship - Not applicable; the property is vacant.

There is no fiscal impact to the City.  The vacant property is valued at $36,180.

 

STRATEGIC GOALS

 

This request indirectly aligns with Strategic Plan Goal #2, "Safety and Security," which encourages maintaining a high level of safety and security for the residential and business communities. 

 

Consolidation of substandard lots is encouraged and aids in development.

AN ORDINANCE OF THE CITY OF LEON VALLEY CITY COUNCIL APPROVING A SUBDIVISION REPLAT BEING APPROXIMATELY 0.269 ACRES OF LAND, ESTABLISHING NEW LOT 56, BLOCK G OR 11, CB 4446, LINKWOOD ADDITION SUBDIVISION, IN THE CITY OF LEON VALLEY.

 

WHEREAS, the City of Leon Valley received a request by Cook Engineering on behalf of Martin and Gloria Sasser, to replat approximately 0.269 acres of land being Lot 9 and 1/2 of Lot 10, Block G or 11, CB 4446, of the Linkwood Addition Subdivision and establishing new Lot 56, Block G or 11, CB 4446, Linkwood Addition Subdivision.

 

WHEREAS, the final replat conforms to Chapter 10, "Subdivisions," of the Leon Valley Code of Ordinances; and

 

WHEREAS, notice was provided pursuant to Chapter 212 of the Texas Local Government Code and a public hearing was held on March 21, 2017 regarding this subdivision replat, at which time parties in interest and citizens were given an opportunity to be heard; and

 

WHEREAS, a public hearing was held and notice provided pursuant to Chapter 212 of the Texas Local Government Code regarding this subdivision replat, at which time parties in interest and citizens were given an opportunity to be heard; and

 

WHEREAS, it is now the desire of the City Council of the City of Leon Valley to approve a subdivision replat for the Linkwood Addition Subdivision Project;

 

NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1.  A subdivision replat has been found to be in substantial conformance and is approved as approximately 0.269 acres of land, being new Lot 56, Block G or 11, CB 4446, the LINKWOOD ADDITION SUBDIVISION.

 

Section 2.  The City staff is hereby authorized to file said replat when all conditions imposed by City Council as reflected in Replat File No. 2017-001 have been complied with in full.

 

Section 3.  A description of the property is attached hereto and incorporated herein as Exhibit "A."

 

Section 4.  This Ordinance shall become effective immediately upon passage by four (4) or more affirmative votes of the entire City Council; otherwise, said effective date shall be ten (10) days from the date of passage hereof.

Community Development Director Kristie Flores presented this item with the purpose to review, consider and conduct a public hearing regarding a request by Cook Engineering on behalf of Martin and Gloria Sasser, to replat approximately 0.269 acres of land being Lot 9 and 1/2 of Lot 10, Block G or 11, CB 4446, of the Linkwood Addition Subdivision and establishing new Lot 56, Block G or 11, CB 4446, Linkwood Addition Subdivision.

Community Development Director Flores concluded the presentation saying that per the requirements of the Local Government Code, Chapter 212, a public hearing is being held and twenty-eight (28) notices were sent to property owners within 200-feet. As of March 8, 2017 no letters were received in favor, opposition but one was returned undelivered. One phone call was received in favor of the replat.

Mayor Riley opened the public hearing at 9:52 p.m.

There being no public comment, Mayor Riley closed the public hearing at 9:52 p.m.

A motion was made by Council Member Benny Martinez and seconded by Council Member David Edwards to approve the replat #2017-001, requested by Marvin & Gloria Sasser to replat 0.269 acres of land, generally located at 7328 Linkmeadow Street as presented.
