PURPOSE

 

To consider approving a Resolution and authorizing the City Manager to enter into a LPAFA between the City of Leon Valley and TxDOT for the funding of the Evers Road bridge reconstruction.

 

The City applied for and was awarded an 80/20 matching grant from the Alamo Area Metropolitan Planning Organization (MPO) for the purpose of reconstructing the Evers Road bridge. As a part of this project, the City must agree to certain conditions as mandated by TxDOT. They are the oversight agency for the Federal Highway Administration (FHA), from whom the funding is received.

 

The agreement mandates such items as the period of the agreement, termination, amendments, scope of work, funding, and each entity's responsibilities during the terms of the agreement.

 

This agreement must be executed before any work may begin.

Social Equity - Assuring efficient and continuous travel, providing improved accessibility for the handicapped, and minimizing the danger from flood hazards improves the general quality of life for all citizens.

 

Economic Development - Improved drainage, safe roadways, and new sidewalks enhance the amenities offered by the City to its residents, which may encourage relocation.

 

Environmental Stewardship - Reducing the amount of scour occurring along the banks of Huebner Creek from substandard stormwater structures improves stormwater quality. 

 

FISCAL IMPACT

 

The agreement is only for the construction portion of the bridge project. The City has already budgeted funds for the engineering and design portion.

 

FHA/TxDOT participation amount:                            $1,661,088

City participation amount:                                                        $  520,233

Total amount:                                                                      $2,295,176

 

In order to receive the federal funds, the City must have the work performed, according to TxDOT standards, and then request reimbursement. This may be done at one time after the project is complete, on a monthly basis, or as pay applications are received. The City will most likely ask for reimbursement on a monthly basis.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN ADVANCE FUNDING AGREEMENT FOR THE RECONSTRUCTION OF THE EVERS ROAD CULVERT AND SIDEWALKS AT HUEBNER CREEK, FROM ALLEY-KINMAN ROAD TO POSS ROAD.

 

WHEREAS, the City of Leon Valley has identified the necessity to reconstruct the Evers Road culvert and related sidewalks at Huebner Creek, from Alley-Kinman Road to Poss Road; and

 

WHEREAS, a Master Agreement between the City of Leon Valley and the Texas Department of Transportation has been adopted and states the general terms and conditions for the development of transportation projects utilizing a LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT (LPAFA) for Local Government Participation Projects; and

 

WHEREAS, the Texas Transportation Commission passed Minute Order 113675 that provides for the development of, and funding for, the Reconstruction of the Evers Road Culvert at Huebner Creek, from Alley-Kinman Road to Poss Road; and

 

WHEREAS, a LPAFA has been prepared that sets forth acceptable terms and conditions of Federal, State and Local participation for the development and construction of PROJECT.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS: that the City Council authorizes the City Manager to execute this LPAFA made between the State of Texas, acting by and through the Texas Department of Transportation and City of Leon Valley.
