PURPOSE

 

Industry Signs, applicant and agent for Stein Real Corporation, property owner is requesting to be granted a variance to add a LED sign panel measuring 45-square feet to an existing multi-tenant sign at Bandera North Shopping Center at 6400 Bandera Road.  The existing multi-tenant sign is 37-feet tall.  The multi-tenant sign was recently updated and the property is renovating and revitalizing a shopping center that has had many vacancies and turnovers since the installation of the Bandera Road Flyover.   Zoning Overlay sign regulations do not allow LED signs.

 

The owner has indicated that the LED sign will mostly have the time and date signature.  The owner has also agreed to keep the signs at a reasonable illumination, so as not to distract drivers along Bandera Road.

 

Staff reviewers have no objection to the requested variance.  It appears to be consistent and compatible with existing and surrounding signage.  Additionally, sign variances for similar signage have been issued to several different business properties in and around the Bandera Road Flyover.

Social Equity - It is equitable for the City to consider Stein Real Corporation’s request as it promotes stakeholder participation with the City. It also promotes a positive stakeholder relationship for future City endeavors/events.

 

Economic Development - Stein Real Corporation’s success in Leon Valley will increase sales tax revenue and promote economic development in the City. Their success is contingent on their marketing and visibility through signage and other means.

 

Environmental Stewardship - Not applicable.

 

FISCAL IMPACT

 

A $200 sign variance consideration fee was paid for consideration of this request.

 

STRATEGIC GOALS

 

This request most closely aligns with Strategic Plan Goal #1, “Economic Development,” to retain quality businesses that will generate sales tax revenue.  Bandera North Shopping Center is a long-time business center in Leon Valley which needs assistance with enhancement and support to promote economic development.  This request nurtures and fosters business growth, revitalization and retention. The Center’s success generates sales tax revenue and thereby sustains economic development in the City.

RECOMMENDATION

 

Staff reviewers have no objection to the variance. Approval is at the discretion of City Council. Chapter 3, “Signs,” of the Code of Ordinances notes that applicants may apply for variances to the Article and that City Council may in turn, consider such variances where strict enforcement due to special conditions or where literal enforcement would result in unnecessary hardship. Approval of this request is consistent with other variance requests approved within this portion of the Bandera Roads Corridor.

GRANTING SIGN VARIANCE #2016-003 ALLOWING AN LED SIGN PANEL IN AN EXISTING MULTI-TENANT SIGN ON CERTAIN PROPERTY LOCATED AT 6400 BANDERA ROAD UPON APPLICATION BY INDUSTRY SIGNS, AGENT AND APPLICANT FOR STEIN REAL CORPORATION, PROPERTY OWNER.

 

WHEREAS, Chapter 216 of the Texas Local Government Code authorizes a municipality to regulate signs erected within the municipality and provide for their sign ordinance administration, enforcement and amendment; and

 

WHEREAS, the Leon Valley Code of Ordinances Chapter 3 and Chapter 14 (the “Code”) regulates the administration and enforcement of sign provisions within the City; and

 

WHEREAS, the City Council has authority to grant variances to the sign regulations of the Code where special circumstances exist and literal enforcement of the Code would result in unnecessary hardship; and

 

WHEREAS, Industry Signs, agent and applicant for Stein Real Corporation for a sign variance to allow an LED sign panel in an existing multi-tenant sign; and

 

WHEREAS, the variance requested will not adversely affect the character of the area, traffic, public health, utilities, safety and general welfare of the residents of the City of Leon Valley; and

 

WHEREAS, it is the desire of the City Council of the City of Leon Valley to grant Sign Variance #2016-003 to allow an LED sign panel in an existing multi-tenant sign on the property located at 6400 Bandera Road upon application by Industry Signs, agent and applicant for Stein Real Corporation, property owner; NOW, THEREFORE,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEON VALLEY, TEXAS, THAT:

 

Section 1.              Sign Variance #2016-003 is hereby granted for a variance to allow a 45 square foot LED sign panel in an existing multi-tenant sign on Lot 41, Block 2, CB 4429A, Bandera North Subdivision, generally located at 6400 Bandera Road, and more particularly described in the case file of Sign Variance #2016-003, attached hereto and incorporated herein as Attachment I.

 

Section 2.               The City staff is hereby authorized to issue said variance when all conditions imposed by the City Council have been addressed and complied with in full.

 

Section 3.  This ordinance is effective immediately upon passage by four (4) affirmative votes; otherwise it is effective on the tenth day after passage hereof.

The existing multi-tenant sign is 37-feet tall. The multi-tenant sign was recently updated and the property is renovating and revitalizing a shopping center that has had many vacancies and turnovers since the installation of the Bandera Road Flyover. Ms. Flores concluded the presentation saying that staff reviewers have no objection to the requested variance. It appears to be consistent and compatible with existing and surrounding signage. Additionally, sign variances for similar signage have been issued to several different business properties in and around the Bandera Road Flyover.

Council Member Benny Martinez said that one of his concerns was the sign for Jerky World still being up after nearly six years of them being gone. He said he hopes Mr. Stein is more receptive to letters from the City in having that sign removed. Same goes for Gold’s Gym. Council Member Martinez told Mr. Fitzsimmons that the City of Leon Valley has an ordinance regulating signs and wanted to know if in the future this would be complied with. Mr. Fitzsimmons replied that he had no idea who the letters had gone to but that he and Mr. Stein do plan to remove the sign. Council Member Martinez went on to say that the City also has an ordinance regarding addresses and asked that the numbers be properly displayed. Mr. Fitzsimmons agreed to comply.

A motion was made by Council Member Benny Martinez and seconded by Council Member David Jordan, to grant a sign variance to Chapter 14, "Zoning Ordinance", Section 14.02.304, "Regulations for All Districts," Part G(2)(j). "Prohibited Signs", to allow an LED sign panel to be added to an existing 37-foot multi-tenant sign with a 45 square foot sign face at 6400 Bandera Road as requested.
